Terms and Conditions

Introduction

Your agreement is with your Pilates trainer (Kat) who delivers your training. These Terms and Conditions form part of your agreement with the Trainer. You understand that the Trainer is self-employed and that you are entering into a contract with her alone. Your instructions to commence pilates training will constitute acceptance of these Terms and Conditions when you will become a client (a “Client” or “you”).

Trainer’s Obligations

The Trainer will use her skills and knowledge to design a safe programme of exercise that will take into account your fitness levels and medical history.

The Trainer will provide the videos, demonstrations and verbal descriptions you need in order to compete your Pilates training. Each virtual class will last between 45-60 minutes unless otherwise agreed.

You understand that the results of any fitness programme cannot be guaranteed. Your progress depends on your effort and co-operation in and outside of the Sessions/Classes. You acknowledge that individual results may vary and that no particular result is guaranteed by your Trainer.
All Client information will be kept strictly private and confidential.

Your Obligations

You are required to arrive on time for each Session/Class so that the Trainer’s full training plan is achieved in each class.

You understand that this membership is for individuals under the same “roof” (household) and is not to be shared between friends and family.

You are required to wear appropriate clothing and have some equipment as suggested below:

·         Pilates bands (essential)

·         Pilates small ball – encouraged

·         Small yoga block - encouraged

·         Pilates circle- optional

·         Weights – only for the fitness videos or classes

Please read the below PAR-Q and message Kat directly if you answer yes to any questions:

Has your doctor ever said you have a heart condition and that you should only do physical activity recommended by a doctor?

Do you feel pain in your chest when you do physical activity?
In the past month, have you had a chest pain when you were not doing physical activity?

Do you lose balance because of dizziness or do you ever lose consciousness?

Do you have a bone or joint problem ( for example back, knee or hip) that could be made worse by a change in your physical activity?

Is your doctor currently prescribing medication for your blood pressure or heart condition? Do you know of any other reason why you should not take part in physical activity?

If you answer yes your Trainer may require a letter of ‘medical clearance’ from your GP. Please be aware that your GP may charge for providing this letter.
You understand and agree that it is your responsibility to inform the Trainer of any conditions or changes to your health, now and ongoing, which might affect your ability to exercise safely and with minimal risk of injury.

If your Trainer requires further medical information from a practitioner, you must provide such details.

If you sustain or claim to sustain any injury while participating in training, you acknowledge that the Trainer is not responsible, except where the injury was caused by her gross negligence or intentional act.

Your Trainer cannot be held liable in any way for undeclared or unknown medical conditions.

 

Health and Safety

You are required to provide your own safe environment to carry out virtual or video classes.

Your Trainer has £4 million public liability insurance cover.

Cancellation Policy

Membership - KM Membership can be cancelled at any time and and access will continue until the end of the monthly block.

Individual Booked Classes - Once your appointment is confirmed, then you are required to give 24 hours notice of cancellation or 50% of the cost will be charged. 

Regular Booked Classes - If you have a regular slot which is reserved, then you are required to give 1 week notice of any cancellation or 50% of the cost will be charged. 

General

You understand that in the unlikely event of your Trainer being unable to continue your training, for any reason, you can request a full refund from your Trainer for any unfulfilled Sessions/Classes.

The Trainer has the right to change these Terms and Conditions, for example, to be able to offer new services or as required by law. The Trainer will notify you of any change. When such a change(s) is made, if dissatisfied you can cancel this agreement once you have made any payments already due to the Trainer.

You are responsible for keeping all your contact information and marketing preferences up to date with the Trainer. In order to comply with the General Data Protection Regulation 2016/679 (GDPR), the Trainer will only do what you ask her to do, or what you have given her permission to do with any personal or sensitive information held about you.

This agreement is governed by the laws of England and Wales and is subject to the jurisdiction of the English courts.
